On 25 and 26 February 1992, following artillery bombardment of Khojaly, the town was captured by Armenian forces and Armenia launched a military operation in Karabakh. The main question is that, whether, according to the records, the deliberate destruction of those who were in Khojaly city, was done because of their nationality and ethnicity? Also, if according to international law, can we term this incident as “genocide”? If so, whether a court has jurisdiction to prosecute the perpetrators of this crime? Furthermore what will be the responsibility of the state of Armenia on this issue? This massacre is one of the international crimes for which no international criminal court has been formed to investigation about until now. This paper examines the Khojaly event from the perspective of international criminal law as an international crime, condemned by various international organizations and countries and it endeavors to examine the legal aspects of this event. Thus, after describing the events and the reaction of countries and organizations to it, legal characteristics of that as an international crime according to international documents and laws to specify the applicable punishments and international responsibility of Armenia government.}, keywords = {International Crime,International Criminal Law,International Responsibility,Karabakh,Khojaly}, title_fa = {مسئولیت بین‌المللی کیفری برای جنایت‌های ارتکابی در خوجالی}, abstract_fa = {رویدادهای قره‌باغ در سال 1988 همراه با تلاش‌های مستمر ارمنستان برای ساختن یک حکومت، به تخریب شهرها، روستاها و قتل و آوارگی صدها نفر از آذربایجانی‌ها از سرزمین مادری خود منجر شد. در 25 و 26 فوریۀ 1992 به‌دنبال بمباران توپخانۀ خوجالی، این شهر به‌دست نیروهای ارمنی تسخیر شد و ارمنستان در قره‌باغ یک عملیات جنگی آغاز کرد. پرسش اصلی این است که با توجه به حقایق ثبت‌شده، نابودی عمدی کسانی که در سال 1992 در شهر خوجالی زندگی می‌کنند، آیا به‌دلیل ملیت و قومیت‌شان انجام گرفت؟ و آیا می‌توان بنابر قوانین بین‌المللی، این رویداد را یک نسل‌کشی نامید؟ اگر چنین باشد، آیا دادگاهی برای محاکمۀ مرتکبان این جنایت صلاحیت دارد؟ و نیز مسئولیت دولت مهاجم در این مورد چگونه خواهد بود؟ این قتل‌عام از جمله جنایت‌های بین‌المللی است که تاکنون دادگاهی برای رسیدگی به آن تشکیل نشده است. در این نوشتار تلاش شده است که رویداد خوجالی از منظر حقوق بین‌المللی کیفری به‌عنوان یکی از جنایت‌های بین‌المللی که سازمان‌های مختلف بین‌المللی و کشورهای متعددی آن را محکوم کرده‌اند، بررسی شود تا ابعاد قانونی و حقوقی این رویداد روشن شود. بدین ترتیب، پس از شرح رویدادها و واکنش کشورها و سازمان‌ها به آن، توصیف حقوقی این رویداد به‌مثابۀ جرمی بین‌المللی با توجه به اسناد و قوانین بین‌المللی صورت می‌گیرد تا مجازات‌های قابل اجرا و مسئولیت بین‌المللی دولت ارمنستان مشخص شود.}, keywords_fa = {جنایت بین‌المللی,حقوق بین‌المللی کیفری,خوجالی,قره‌باغ,مسئولیت بین‌المللی}, url = {https://jcep.ut.ac.ir/article_65261.html}, eprint = {https://jcep.ut.ac.ir/article_65261_816d442923e733a9320a7151b395240a.pdf} }
